1.1 These Terms and Conditions govern the rental of vehicles from BRAINS TOURS.
1.2 By signing the Rental Agreement or using our services, you the Hirer agree to comply with these Terms and Conditions.
2.1 You must be at least 21 years old and hold a valid driver’s license for a minimum of 2 years.
2.2 Drivers licenses not in English must be accompanied by an International Driving Permit (IDP).
2.3 Only drivers named in the rental agreement are permitted to drive the vehicle.
3.1 The rental period begins and ends on the date and time stated in the Rental Agreement.
3.2 If the vehicle is returned late without prior approval, additional charges will apply.
3.3 Extensions must be authorized by BRAINS TOURS in writing.
4.1 The Hirer agrees to use the vehicle in a careful and lawful manner. The vehicle may not be used for:
Off-road or racing purposes
Carrying passengers or goods for hire
Towing, pushing, or propelling other vehicles
Any illegal activity
Driving under the influence of alcohol or drugs
4.2 Misuse or unauthorized use may result in immediate termination of the agreement and liability for damages.
5.1 The rental includes basic insurance (e.g., third-party liability).
5.2 Optional insurance coverage (e.g., Collision Damage Waiver, Theft Protection) may be purchased for additional protection.
5.3 The Hirer is responsible for:
Any damage not covered by insurance
Insurance excess (Payable by the hirer)
Damage due to negligence, violation of the agreement, or unauthorized use
6.1 Vehicles are provided with a [Full/Quarter/Half] tank of fuel and must be returned at the same level.
6.2 A refuelling charge will apply if the vehicle is returned with less fuel than when it was collected.
7.1 Full payment and a refundable security deposit must be made before vehicle release.
7.2 BRAINS TOURS accepts cash, credit/debit card, mobile money.
7.3 The deposit will be refunded upon return of the vehicle in acceptable condition, minus any charges.
8.1 In case of mechanical breakdown, contact BRAINS TOURS immediately at +254 722747211.
8.2 In case of an accident:
Report the incident to local authorities and obtain a police report (OB)
Notify BRAINS TOURS immediately
Complete an accident report form upon return
9.1 Cancellations made more than 48 hours in advance may be eligible for a refund.
9.2 Cancellations made less than 48 hours in advance or no-shows may result in forfeiture of payment.
10.1 BRAINS TOURS reserves the right to terminate the rental agreement without notice if:
You breach these Terms
The vehicle is misused
10.2 Upon termination, the Hirer must return the vehicle immediately.
11.1 These Terms and Conditions are governed by the laws of the Republic of Kenya.
11.2 Disputes shall be resolved through the courts of Kenya.
